Search and Consent: When to Say No / Búsqueda y consentimiento: cuándo decir no
What Does "Consent to Search" Mean?
- Police often ask if they can "look inside" your bags, phone, or car. If you say "yes," they have legal permission to search everything.
- You do NOT have to say yes. You can say: "I do not consent to any searches."
- Saying no does not mean you are guilty — it protects your rights.
When Can Police Search Without Your Consent?
- If they have a warrant signed by a judge.
- If they have probable cause (a good reason to believe you're involved in a crime).
- If you're under arrest, some searches are allowed.
- Remember: If you refuse consent, police might still try to search anyway. Do not physically resist — stay calm, say clearly you don't consent, and ask for a lawyer.
- La policía a menudo pregunta si pueden "revisar" tus bolsas, teléfono o automóvil. Si dices "sí", tienen permiso legal para registrar todo.
